Collecting data is turned on by default is not cool. If you think you are saved by your Terms & Condition in your site, that will not work, as if somebody download just from WordPress .org, went to your website just to register, and have not looked at terms, like I was not forced to read even. In WordPress.org plugin you need permission from user to call home.
